Can you help with my strange debt collection situation

A collector is calling me and stating I owe $10,000 to my former University; The debt's from 2001 and the collector sent me documentation from the school as proof of the debt. I called the school and they said it was legit but couldnt tell me the details of why I owed. They said their systems have changed. THIS IS NOT A SCHOOL LOAN DEBT but rather owed to the school.

The collector gave me a payment option as a large down payment and monthly payments over a period of time but I cannot afford them at this time. They also sent me a letter saying that my debt can be litigated and a judgement can be obtained against me.

The debt still has NOT gone on my credit report either. What are my options to take care of this?

Why hasnt the debt gone on my credit report after almost 7 years?

As strange as it sounds, I was truly unaware of this debt until i was contacted by the collector recently. I moved several times but no one EVER contacted me through phone or mail.

Any advice?

The school can't give you details on a 10k debt? Do you have any idea what the charge is for? Tuition?

What kind of validation did you get? Did you get all copies of papers you signed agreeing to this debt?

They can only report the debt on your credit report. for seven years, if it is accurate. A bankruptcy can only be reported for 10.



The reason it is not on your credit report is because if it is more than seven years then legally they cant

Yea if its not on your credit report as them to send you a bill for why you own them that much....You are entitled to see what charges you rang up for your debt and if they say no...then you say you cant pay..

I say if it hasn't gone on your credit report, f&ck em. If you owed 10 grand it would not be a mystery.

Here is what you do.....



Nothing.



Cool huh?



For starters, as Abe pointed out this debt is over 7 years old. Legally they can not put anything on your credit report after 7 years from the date of the delinquency. If you even see this pop up, dispute it and file a lawsuit against the collection agency (very easy to do....and you WILL win).



Next, you don't mention what state you live in, but most states have statute of limitations laws that say you can't sue for debts after 6 years (the average). If you are SURE this is not a student loan issue, they can not sue you.



Now...they say you owe them money and it's legit.....but they have no contract, bills, invoices.....no explanation at all of why you owe them. They just know you do.



That is going to last about 2 minutes once it goes before a judge...then he will toss it out.



Do this....send the university a bill saying they owe you money.....you don't know why but you know they owe you. Do you think they will send you a payment? Of course not...these are college people intelligent enough to know better. So why would you do something stupid like that?



Tell them to prove their debt or leave you alone.

They have to give you a detailed copy of what the charges are. They should be in your file and only take a few minutes to get to.



They got to them to come up with that bill.



I would refuse to pay until they give you a detailed report of the charges.



My son left a school owing $600 and they let him know 30 days after he left and exactly what and why he owed down to the last french fry out of the cafeteria. So, this don't look right to me. I don't think they can even collect it after 7 years of no contact.
